Terms and Conditions of Use — WhatTheMould
Welcome to WhatTheMould. These Terms & Conditions (“Terms”) form a binding agreement between you and Project Alix Limited (a company registered in England and Wales under company number 15125580, registered office 5 Buck Street, Camden, London NW1 8NJ — “Project Alix”, “we”, “us”, “our”).
By creating an account, using the WhatTheMould mobile app, or using our website at whatthemould.com (together, the “Services”), you confirm that you accept these Terms and that you agree to comply with them. If you do not agree, do not use the Services.
1. Who can use WhatTheMould
You must be at least 18 years old to use WhatTheMould. The Services are not intended for anyone under 18.
The Services are currently available only in the United Kingdom.
2. What WhatTheMould does — and what it is not
WhatTheMould helps you document damp and mould at home. You walk through your rooms, describe what you see, take some photos, and answer a few questions. We generate a report for you, including a letter you can send to your landlord if you choose.
WhatTheMould is not a legal service, a medical service, a professional surveying service, or a replacement for any of them. Reports we generate are your own document, based on what you told us and what you showed us. If you have a health concern that you think is related to damp or mould, speak to your GP. If you need a formal surveyor’s report, speak to a qualified surveyor.
Reports are generated using artificial intelligence and may contain errors. You should review your report for accuracy before you rely on it or send it to anyone.
3. Your account
Your account is personal to you. You are responsible for keeping your password secure and for what happens on your account. If you think someone else has access to your account, contact us at ask@projectalix.com so we can help.
You can delete your account at any time from within the app. When you delete your account, we soft-delete your data first and hard-delete after 30 days, as described in our Privacy Policy.
4. Content you provide
You keep all rights in the voice recordings, photos, notes and other content you provide through WhatTheMould (“Your Content”).
You give us a licence to use Your Content to provide the Services to you — for example, to generate your report, transcribe your voice, produce a landlord letter, and store your report so you can come back to it later.
You also give us a licence, on the terms of our Privacy Policy, to use anonymised versions of Your Content:
(a) to train and improve our AI models;
(b) to conduct academic and independent research into damp, mould and related housing issues, including in partnership with universities; and
(c) where you have separately opted in through your profile, to share anonymised content and (with your explicit consent) your contact details with third-party service providers, advertising and marketing partners for lead generation, and affiliate partners.
You can opt out of the third-party sharing, lead generation and affiliate uses at any time from your profile.
You promise that Your Content:
(a) is accurate to the best of your knowledge;
(b) is either yours or shared with us with the permission of anyone whose home, image or voice is captured;
(c) does not contain unlawful, harassing, defamatory, misleading, malicious or infringing material.
If we reasonably believe Your Content breaches this section, we may remove it or suspend your access.
5. Landlord letter and third parties
When you use the landlord letter feature, you (not WhatTheMould) send the letter to your landlord. We are not a party to the relationship between you and your landlord. We do not represent you legally, and we do not act on your behalf. The letter is a starting point drafted from Your Content; you should review it before sending and change anything that is wrong.
We are not responsible for how your landlord responds to any letter or report you send, or for the outcome of any conversation you have with your landlord.
6. Tips and product recommendations
Our Services include a Tips section with suggestions for keeping mould at bay and product recommendations. Some product recommendations are affiliate links — if you buy through them, we may receive a small commission. Affiliate links are marked in the app.
Product recommendations are for information only. We do not warrant that any recommended product will address the mould in your home, and we are not a party to any purchase you make.
7. Intellectual property
The WhatTheMould app and website, the “WhatTheMould” and “Alix” names, marks, and the underlying platform, models, algorithms and content (other than Your Content) are the intellectual property of Project Alix. We grant you a personal, non-transferable, revocable licence to use them for your personal, non-commercial use of the Services.
Nothing in these Terms transfers any intellectual property in the Services to you.
8. Privacy
We process personal data as described in our Privacy Policy at whatthemould.com/privacy. In respect of WhatTheMould, Project Alix is the Data Controller.
9. Your obligations
By using the Services you agree that you will:
(a) provide accurate information;
(b) not use the Services to record voice or take photos of people who have not agreed;
(c) not use the Services to send unlawful, harassing, defamatory, misleading, malicious or infringing content;
(d) not attempt to reverse-engineer, decompile or interfere with the Services;
(e) not use the Services to impersonate someone else or to submit reports about a home that is not yours without the permission of the person whose home it is.
10. Warranty disclaimer
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, that the Services will be uninterrupted, error-free, or fit for a particular purpose. We do not warrant the accuracy, completeness or usefulness of any content generated by the Services.
Nothing in these Terms affects any rights you have under consumer law that cannot be excluded or limited.
11. Limitation of liability
To the fullest extent permitted by law, and subject to the paragraph below, Project Alix’s aggregate liability to you under or in connection with these Terms is limited to £50.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or your rights as a consumer that cannot be excluded.
12. Suspension and termination
You may stop using the Services at any time by deleting your account.
We may suspend or terminate your access at any time, without notice, if:
(a) you materially breach these Terms;
(b) we are required to do so by law;
(c) we reasonably believe your continued access would cause harm to Project Alix, other users, or third parties; or
(d) we discontinue the Services.
On termination, your right to use the Services ends immediately. Sections that by their nature survive termination will continue in effect.
13. Changes to these Terms
We may update these Terms from time to time. Where the change is material, we will notify you through the app or by email and ask you to accept the updated Terms before you can continue using the Services. Where the change is not material, continued use of the Services after we post the updated Terms will constitute acceptance.
14. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them are governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim, save that if you are a consumer resident elsewhere in the United Kingdom, you may bring proceedings in the courts of the country in which you reside.
15. General
Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our consent. We may assign our rights and obligations to a successor or affiliate.
Severability. If any provision of these Terms is held to be unenforceable, that provision will be severed and the remaining provisions will continue in effect.
Waiver. A failure or delay in enforcing any provision of these Terms does not constitute a waiver.
Third-party rights. No one other than a party to these Terms will have any right to enforce any of these Terms.
